{"id":6049,"date":"2025-08-19T14:20:47","date_gmt":"2025-08-19T18:20:47","guid":{"rendered":"https:\/\/bombazoinformativo.com\/?p=6049"},"modified":"2025-08-19T14:20:48","modified_gmt":"2025-08-19T18:20:48","slug":"investigan-a-cuatro-suplidores-por-presunta-colusion-en-licitacion-almuerzo-escolar","status":"publish","type":"post","link":"https:\/\/bombazoinformativo.com\/index.php\/2025\/08\/19\/investigan-a-cuatro-suplidores-por-presunta-colusion-en-licitacion-almuerzo-escolar\/","title":{"rendered":"Investigan a cuatro suplidores por presunta colusi\u00f3n en licitaci\u00f3n almuerzo escolar"},"content":{"rendered":"\n<p>Santo Domingo. \u2013 La\u00a0<strong>Direcci\u00f3n Ejecutiva de la Comisi\u00f3n Nacional de Defensa de la Competencia (Pro-Competencia)\u00a0<\/strong>inici\u00f3 una investigaci\u00f3n de oficio contra cuatro empresas proveedoras del Estado por la existencia de indicios razonables de haber incurrido en\u00a0<strong>pr\u00e1cticas de colusi\u00f3n en licitaciones del almuerzo escolar del Instituto Nacional de Bienestar Estudiantil (INABIE).<\/strong><\/p>\n\n\n\n<p>La acci\u00f3n, formalizada en la resoluci\u00f3n RII-DE-AAC-003-2025, se origina tras una alerta remitida por el propio INABIE y un an\u00e1lisis preliminar de la participaci\u00f3n de las empresas<strong>&nbsp;Ysabel Gourmet, S.R.L., Guizo y Sabor, S.R.L., D\u2019Angel\u00b4s Cooking By Sandez, S.R.L. y Crisandez Gourmet, S.R.L<\/strong>., en tres procesos de compra para el Programa de Alimentaci\u00f3n Escolar (PAE) realizados entre 2022 y 2023.<\/p>\n\n\n\n<p>La investigaci\u00f3n preliminar de la Direcci\u00f3n Ejecutiva&nbsp;<strong>detect\u00f3 un patr\u00f3n de conducta sistem\u00e1tico y at\u00edpico a trav\u00e9s de los tres procesos<\/strong>, que incluye v\u00ednculos societarios entre los oferentes, el uso compartido de los mismos auditores y notarios, as\u00ed como la obtenci\u00f3n de documentos clave como p\u00f3lizas de fianza y permisos sanitarios con numeraci\u00f3n consecutiva y en las mismas fechas, lo cual sugiere una posible coordinaci\u00f3n para manipular los resultados de los procedimientos.<\/p>\n\n\n\n<p>La conducta investigada se tipifica de manera preliminar en el art\u00edculo 5, literal \"b\" de la Ley 42-08, que proh\u00edbe los acuerdos para coordinar ofertas.<\/p>\n\n\n\n<p>La&nbsp;<strong>Direccion Ejecutiva de Pro-Competencia aclara que esta resoluci\u00f3n da inicio a la fase de instrucci\u00f3n.<\/strong>&nbsp;Esta es una etapa en la que se profundizar\u00e1 en los hechos y se garantizar\u00e1 plenamente el derecho a la defensa de las empresas investigadas, las cuales se presumen inocentes hasta que una decisi\u00f3n final y firme determine lo contrario.<\/p>\n\n\n\n<p><strong>Sobre Pro-Competencia<\/strong><\/p>\n\n\n\n<p>La&nbsp;<strong>Comisi\u00f3n Nacional de Defensa de la Competencia<\/strong>&nbsp;es el organismo aut\u00f3nomo del Estado dominicano encargado de promover y defender la competencia efectiva para incrementar la eficiencia econ\u00f3mica en los mercados de bienes y servicios, en beneficio de los consumidores y del inter\u00e9s p\u00fablico.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Santo Domingo. \u2013 La\u00a0Direcci\u00f3n Ejecutiva de la Comisi\u00f3n Nacional de Defensa de la Competencia (Pro-Competencia)\u00a0inici\u00f3 una investigaci\u00f3n de oficio contra cuatro empresas proveedoras del Estado por la existencia de indicios razonables de haber incurrido en\u00a0pr\u00e1cticas de colusi\u00f3n en licitaciones del almuerzo escolar del Instituto Nacional de Bienestar Estudiantil (INABIE).
