{"id":5424,"date":"2025-06-23T14:29:48","date_gmt":"2025-06-23T18:29:48","guid":{"rendered":"https:\/\/bombazoinformativo.com\/?p=5424"},"modified":"2025-06-23T14:34:00","modified_gmt":"2025-06-23T18:34:00","slug":"abogada-yamile-gutierrez-propone-realizar-un-estudio-legal-y-tecnico-riguroso-del-proyecto-de-ley-sobre-juegos-de-azar","status":"publish","type":"post","link":"https:\/\/bombazoinformativo.com\/index.php\/2025\/06\/23\/abogada-yamile-gutierrez-propone-realizar-un-estudio-legal-y-tecnico-riguroso-del-proyecto-de-ley-sobre-juegos-de-azar\/","title":{"rendered":"\"Abogada Yamile Guti\u00e9rrez propone realizar un estudio legal y t\u00e9cnico riguroso al proyecto de ley sobre juegos de azar\""},"content":{"rendered":"\n<p>SANTO DOMINGO.- Con el objetivo de que se garanticen las reglas, la seguridad jur\u00eddica y los mecanismos que permitan la formalizaci\u00f3n y sostenibilidad del sector, la abogada especialista en juegos de azar Yamile Guti\u00e9rrez recomend\u00f3 el estudio en los \u00e1mbitos legales y t\u00e9cnicos del proyecto de ley sometido por el presidente Luis Abinader que busca regular los Juegos de Suerte &amp; Azar en el pa\u00eds.<\/p>\n\n\n\n<p>Guti\u00e9rrez, experta en este tipo de legislaci\u00f3n y socia fundadora de G&amp;G Studio Legal, primera firma especializada en juegos de azar, advirti\u00f3 que la pieza presentada contiene una serie de disposiciones que, lejos de fortalecer la institucionalidad y proteger a los operadores y ciudadanos, podr\u00eda generar efectos negativos a nivel social, fiscal y \u00e9tico.<\/p>\n\n\n\n<p>En ese sentido, tras saludar la iniciativa legislativa y reconocer la necesidad de un proceso de transformaci\u00f3n y actualizaci\u00f3n que provea un marco normativo moderno y eficiente que regule de forma adecuada las actividades relacionadas con los juegos de azar, se\u00f1al\u00f3 algunas oportunidades de mejora en el contenido del proyecto.<\/p>\n\n\n\n<p>\u201cLa creaci\u00f3n de una Direcci\u00f3n General de Juegos de Azar, que ser\u00eda el nuevo ente regulador, reconozco que era necesario que este organismo sea totalmente aut\u00f3nomo, pero este proyecto de ley delega y otorga facultades regulatorias, sancionadoras y administrativas, donde debi\u00f3 de ser la misma ley que describiera y estipulara todas estas prerrogativas legales y no delegando estos sistemas de control al nuevo ente regulador.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img decoding=\"async\" width=\"640\" height=\"366\" src=\"https:\/\/bombazoinformativo.com\/wp-content\/uploads\/2025\/06\/revelasuicidiospaisrelacionanjuegosazar_1_2414783.jpg\" alt=\"\" class=\"wp-image-5426\" style=\"width:411px;height:auto\" srcset=\"https:\/\/bombazoinformativo.com\/wp-content\/uploads\/2025\/06\/revelasuicidiospaisrelacionanjuegosazar_1_2414783.jpg 640w, https:\/\/bombazoinformativo.com\/wp-content\/uploads\/2025\/06\/revelasuicidiospaisrelacionanjuegosazar_1_2414783-300x172.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n\n\n\n<p>Esta sola situaci\u00f3n generar\u00eda una inseguridad jur\u00eddica para los operadores ya establecidos, ante posibles interpretaciones arbitrarias de la ley o cambios de las regulaciones t\u00e9cnicas mediante posibles resoluciones administrativas carentes de fundamentos legales\u201d, afirm\u00f3 Yamile Guti\u00e9rrez.<\/p>\n\n\n\n<p>Asimismo, la especialista sostuvo aunque el proyecto hace referencia a un r\u00e9gimen fiscal \u201cequitativo\u201d, la realidad no es as\u00ed, sino que refleja un aumento impositivo insostenible para el sector.<\/p>\n\n\n\n<p>\u201cEste proyecto debi\u00f3 de proponer, en primer lugar, que la tributaci\u00f3n sea en base al GGR (Gross GamingRevenue) es decir, los ingresos procedentes del juego menos la ganancia de los jugadores y segundo un porcentaje de esos recaudos fiscales, sea destinado al sector salud, a programas de ludopat\u00eda o a desarrollo de programas deportivos, que tanta falta le hace al pa\u00eds. Esta modalidad de r\u00e9gimen tributario es aplicada en diversos pa\u00edses de Latinoam\u00e9rica, y puede servir de base para nuevas normativas fiscales en el sector de juegos de que replica y unifica los criterios legales, fiscales y recaudatorios actuales en un solo documento.<\/p>\n\n\n\n<p>\u201cEl prop\u00f3sito que persigue el Estado Dominicano es tener mayor control de los ingresos producto de las ganancias obtenidas de las apuestas, y establecer por ley la promoci\u00f3n e implementaci\u00f3n de las acciones del juego responsable, la sensibilizaci\u00f3n sobre la ludopat\u00eda y la protecci\u00f3n de menores en estos centros o como ser\u00e1n llamados ahora \u201ccasas de apuestas\u201d.<\/p>\n\n\n\n<p>Yamile Guti\u00e9rrez valor\u00f3 positivamente que por primera vez se contemple una pol\u00edtica p\u00fablica e integral orientada a la prevenci\u00f3n del juego compulsivo, incluyendo campa\u00f1as de concientizaci\u00f3n sobre el juego responsable, una l\u00ednea telef\u00f3nica gratuita de asistencia y la creaci\u00f3n de un Registro Nacional de Autoexclusi\u00f3n, donde los ciudadanos podr\u00e1n solicitar ser excluidos voluntariamente de
